Terms of Service

These Terms of Service (“Terms”) govern access to and use of Arbiter, Bench, and the website provided by Akaro Health Inc. By using the service, you agree to these Terms.
1. The Service
Arbiter provides independent outcome validation of outsourced vendor contracts for health plans; Bench provides free, public-CMS-data benchmarks for health plans and counties. Features may evolve over time.
2. Accounts and Access
You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Access is limited to authorized users of a subscribing organization.
3. Customer Data
You retain all rights to data submitted to the service. You grant Akaro a limited license to process that data solely to provide and improve the service, consistent with our Privacy Policy and any applicable Business Associate Agreement.
4. Acceptable Use
You agree not to misuse the service, including attempting unauthorized access, interfering with its operation, or using it in violation of applicable law or regulation.
5. No Medical or Legal Advice
The service provides analytical and administrative tooling only. It does not constitute medical, legal, billing, or coding advice, and decisions based on its output remain your responsibility.
6. Disclaimers and Limitation of Liability
The service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Akaro's aggregate liability arising out of these Terms is limited to the amounts paid for the service in the twelve months preceding the claim.
7. Termination
Either party may terminate as set out in the applicable subscription agreement. Upon termination, your right to access the service ceases, and data is returned or deleted in accordance with our agreements.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
